Is my project Grandfathered? This is a common misconception and one of the most frequent comments we hear. Quite often the owner and/or tenant is under the impression that the accessibility guideline apply only to new building and not to renovations of existing buildings. Private sector facilities that are places of public accommodation have a continual barrier removal obligation, which is a far cry from the paternal protection of grandfathering. And for new construction? You’re expected to get it right the first time. Unfortunately, few do. Before you remove any potential barriers, though, you have to know what they are and that not all barriers are created equal.
The ADA is a civil rights law and places the responsibility on the owner for ongoing barrier removal. A prudent owner (or potential entity looking to purchase an existing property) should have the facility assessed to note any elements which are not in compliance. The TAS requirements do not have an ongoing barrier removal requirement. When building a new facility or altering an existing facility in Texas, you’re required to comply with the current Texas Accessibility Standards and these Standards are applied during construction like other building codes.
